Should We Write Prenuptial Contracts?
نویسنده
چکیده
A successful marriage requires for both parties to make investments in their relationship and marital assets. How such assets would be divided if and when the parties divorce is an important factor determining each party’s (exante) investment incentives. Using the “incomplete contracting” approach, we characterize the optimal asset division rule, one that provides the parties with the best investment incentives. We then discuss the circumstances under which the spouses would agree, in equilibrium, to write a prenuptial contract with this asset division rule. We conclude by exploring the implications of our results in the context of various asset division rules currently discussed

Muslim family law, prenuptial agreements and the emergence of dowry in Bangladesh∗
Existing theoretical and empirical research on dowries has difficulty accounting for the large changes in dowry levels observed in many countries over the past few decades. To explain trends in dowry levels in Bangladesh, we draw attention to an institutional feature of marriage contracts previously ignored in the literature: the mehr or traditional Islamic brideprice, which functions as a pren...
متن کاملSupplementary appendix to Muslim family law, prenuptial agreements and the emergence of dowry in Bangladesh: dynamic analysis
This is a companion paper to Ambrus, Field and Torrero (2008). We extend the theoretical analysis of a marriage market with prenuptial agreements to a dynamic setting, in which individuals can reenter the marriage market after failed marriages. We show that the qualitative conclusions of the static analysis remain valid in the dynamic framework.
متن کاملShould Courts Always Enforce What Contracting Parties Write?∗
We find an economic rationale for the common sense answer to the question in our title — courts should not always enforce what the contracting parties write. We describe and analyze a contractual environment that allows a role for an active court. An active court can improve on the outcome that the parties would achieve without it. The institutional role of the court is to maximize the parties’...

This dissertation introduces a framework enabling the dynamic verification of expressive specifications. Inspired by formal verification methods, this framework supports assertion, framing, and separation contracts. Assertion contracts specify what code should do, whereas framing contracts specify what code must not do. Separation contracts, inspired by separation logic, combine an explicit ass...
